There are people from EB3 with PDs in late 2001 and 2002 and 2003 who were not able to file I-485 due to the delay at BEC. These numbers excludes them I wonder how many EB3-I applications that would be!

Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

Send me PM and I can ask my friend, who was invloved in big accident like you. Insurance company will fight for the last penny and after that you have to pay, if it is not covered.

EB3 I is bad and will get worse. EB 3 ROW will also get screwed big time because of the 300k namecheck victims who are now eligible for visas. Trickle down will also be impacted because of that. USCIS uses short sighted methods to clear their hurdles, they dont realize that there is person behind each visa number. The only thing certain for EB 3 is that in OCT EB 3 will revert back to the June 08 dates.
The sad fact is that most of us were screwed because the lawyers suggested to our companies that EB3 is easier to process than EB2.

I would say ignore. If the hosts dont even use 'controversial' to describe him it's pointless trying to call in - its going to be an 'immigrant hate-fest' whether you call in or not and you are not going to win hearts or change minds. I remember 4 or 5 years ago he was raging against the H1 on air as usual and turned around to his staff and asked if CNN too was using the H1program - and the answer unsurprisingly was 'yes'. He has no sense of shame or a modicum of decency - none of his staff members either. And IV is ill-positioned and too narrowly focussed to take him on in any meaningful way given how a core member spoke against the z-visa (for illegals) to some n.carolina newspaper. But again I could be wrong so someone could give it a shot

you had waited for such a long time. I would suggest to take a big break and visit india and come back. In fact you can do the same in EAD. Think forward don't get your emotions in the way.
That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

Is it true that for a company w/ more than 100 employees, a statement letter from the CFO will be adequate as a proof for ability to pay? What info should the CFO be included in the letter?

I did an AC21 before my GC got approved. I did this on my EAD card and when I joined I filed my I9 form for taxes. Now after getting GC do I need to renew my I9 form or the old one stays valid?
Also since I am not with my GC sponsoring employer do I still need to follow the 6 months rule with my current employer since date of approval?
Also can we move this compilation to IV Wiki?
#1 You need to update the I-9 form of verification because previously you employment authorization was the EAD card now your employment authorization is the GC card.
#2 First of all there is no 6 month rule. Secondly even if theoretically there is a undefined period it does not apply to you anymore since you are no longer with your GC filing employer.

Here is a suggestion for you:
1) Book a round trip ticket for your wife to fly back immediately. Meanwhile, take an appointment for your wife with a local USCIS cert civil surgeon to take the TB test/vaccine. Take it wherever you can get it -near or far.
2) Get lawyer to draft the RFE response. Submit the doc's report to lawyer as soon as you get it. (most surgeons will give it in a day or two after checking the bump.)
This whole process should be done in less than a week if you can prepare everything else before your wife gets here.
3) Wife flies back and continues with rest of vacation with kids. You can have your Euro vacation at the end too! :)
Downside: Twins will have to be away from Mom for a week.
Upside: Monetary Losses and life disruption cut as short as possible.

Alot of members have fled to immigrationvoice with a hope to get their GC very quickly. Today the organization have received a final blow in its coffin when the House Judiciary Committee did'nt even look at HR5882.
Members are always been targeted for contributions for lobbyists, free lunch etc. and yet nothing concrete have been acheived by IV. I have never seen this website(immigrationportal) ask members for a single dollar yet have been just as helpful or even more helpful than IV and also this website is flame free you can express your self without fear. At IV to disagree you are a moron..(GIVING RED DOTS, ACTING LIKE A GROUP OF KINDERGARDEN KIDS, NO WONDER THE HORSE BILL WAS MARKUP AND HR5882 ISN'T)
I think its time for the chicken to come back to roost, the grass is not always greener on the other side. Save your money in this time of need and lets us make this site what it was in past before when some selfish persons seeking self gratification lure away members. The moderators of this site is to blame because they played a part in sucking up them, by deleting post that IV is not pleased of and giving aways members IP, thus in the process leaving this site to die a slow death.

The approval notices of the H1B renewals and transfers that I got in the past, the I94 at the bottom had the same number as the one that was given at the port of entry while returning from the last abroad trip made prior to the renewal/transfer.
But in my case, the old I94 had the H1B written on it, as opposed to "parolee" as is your case. So I am interested to also know how your approval turns out.
I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.
I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.
Finally, I did not get any RFE.

that was the idea behind it, but when a feature is being misused and exploited that needs to be plugged. If microsoft needed a genius they can bring that person in on EB1 or H1B or B1 visa. there are many other avenues.
How do u feel that a person who arrives in US yesterday, buys a labor, gets his GC within a year while thousands of us are waiting patiently.
It is an unfair practice and should have been stopped long time back.
It's never too late though.
Selling labors became the business model of manyof these companies.
Are they doing anything illegal? NO.
Are they doing something ethical? NO
So, the law has to change to give everyone a fair chance.
