My I140 was denied on Ability to Pay....my company 2006 profit is in negative...but company is saying that the have a lot in Accounts Receivable which was not considered by USCIS....
any cases similar to this???

I know you are a committed member and you contribute as well. You have been helping the holiday thread to be on the top too. I was talking about my IV holiday fund raising to one of my co-worker who is a US citizen and who does not have an Indian/ Asian ethnic background and he had mentioned to me you guys are 25,000 people and all of you are hard working legal immigrants. you dont need to go to anyone else for money. your group is financially very strong. If all of you put in 10$ each month you will have 250K funds available every month. What you should really work on is get every member to commit to that 10$ every month. What can we do to get every one of us put in that 10$ every month?

My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.
Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

Ok, if advertising is too far-fetched, then hold some cultural events and make money on those. Brainstorm with members to find other ways to make money. People are not going to contribute. That is the writing on the wall. There is lack of trust and lack of faith in IV. IV will have to figure out ways to generate cash from other things than member contributions. If I remember correctly, people contributed nearly $200K and have got nothing to show for that.
These suggestions are because you think money is the issue. I don't think it is. It's the lack of good leadership. That is my opinion and it was point of my original posting. Lack of money is being blamed wrongly. But may be I am wrong.
Attack my ideas and not me. Then we can have a debate conducive to achieving our goals.

As you are aware there is alot going on right now. The administration is talking about CIR.
Lots of bills with small provisions get talked up or introduced. In fact that happens every year if you look back. We keep an eye on what's moving and where the effort is needed. We do not want to waste our resources and effort if something may end up simply being a placeholder or a position statement.
In a nutshell, there will be fax campaign when we are advised (by lawmakers, lobbyists and friendly advocacy groups among others) and we determine that it is needed and will be effective.
Thanks for the response Paskal. However I still do not underststand why IV is not encouraging everyone to send faxes and register their support via the AILA site. As I have understood AILA has been a leader in this effort for immigration {see July 2007}. If you are trying to say that the interests of AILA and IV are not exactly the same - that is to be expected - no 2 organizations can ever be the same - BUT - surely we can come together to form and pursue some strategic interests. I see that with regard to these bills IV and AILA interests meet. Further if readers @ IV send messages via AILA Action Alert then IV resources can be saved to follow the path that you have described above.
Finally, the bill may be a placeholder or position statement, but in the end we need to demonstrate the numbers - highlighting this bill may eventually lead to some worthwhile convergence in the CIR - I think no opportunity need be lost in this process and the more we highlight our position and condition the more visibility we get.

Immigration Voice is organizing its first peaceful protest rally in San Jose, CA on July 14th in order to protest the broken system of legal high-skills immigration. This protest march is being organized to oppose the enormous visas backlogs in the employment based immigration system. This protest march is also intended to oppose the recent decision of USCIS to block the adjustment of status petitions in July resulting from an unprecedented out-of-order reversal on the part of DOS and USCIS.
Please join this rally in huge numbers to create more awareness in the Media, Congress and the Administration. I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.
It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.
How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.
What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.
Any help/suggestion/comment?

Both DOS and USCIS do believe the recap bill is going to improve their efficiency. They had made it very clear in the Immigration subcommittee hearing on "wasted visas" held on Apr 30.
They might got feed back from DOS and USCIS also.
I hope DOS and USCIS give positive feedback to recapture visas.

I will continue to contribute to IV even I get my GC in few months (highly unlikely) until the goals of IV are met. Also salutations and big thanks to the spouses and families of IV core. Their contribution and sacrifice is unsung, but in my opinion their sacrifice of their loved ones time and spending all savings for good cause is remarkable in itself. A big applause to the families of IV core for being so understanding.

Do we really believe there aren't enough Americans to handle IT work in America?
yes. I honestly do. Having been through multiple recruitment attempts, at three different companies, in the bay area of all places: there are simply not enough qualified/interested american citizens available.
H-1b is not cheap labor. American companies prefer to hire H-1bs with US master's degrees or with substantial amounts of US experience. When they do hire foreigners, they do not discriminate against them by paying them lesser.
H-1bs are abused by desi vendors and the like who take advantage of the indenturing nature of the visa and also on the naivety of "fresh off the boat" people who newly arrive into the US and are unfamilar with US economy. They are starry eyed, still busy converting each dollar into their local currency and feeling happy they are earning relatively more and dreaming about paying off their EMIs back home, sooner. It takes quite a few months for them to settle down and understand US dynamics.

Lastly, we should not confuse the need for H-1bs as equal to the need for GC holders. Take the example of middle eastern countries. They use foreign labor, but they never grant them permanent status. That way, they do not get stuck with them in the event of a downturn. American could have chosen to follow a similar model. Use H-1b temps when necessary and send them out when they are expendable. They have no reaons to hand out GCs, like I said earlier. The benefit is all ours.
good point. However unlike the kind of work being done in the middle-east, there are a ton of companies in the US founded or co-founded by immigrants. There is a reason this place is called the land of immigrants. Handing out GCs gives these people options to start companies and many many of them do. this creates jobs, creates more intellectual capital, all within the US. In 6 years if you make a cook in Dubai leave and go back to Kerala (just picking a typical example) he is not going to do anything to compete with Dubai. You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.
If there is any kind of immigration that I think the US does not gain much from, its the diversity lottery and to an extend the chain migration that comes from family based immigration. EB immigration is a BIG win for the US economy.

If there is any kind of immigration that I think the US does not gain much from, its the diversity lottery and to an extend the chain migration that comes from family based immigration. EB immigration is a BIG win for the US economy.

As your lawyer used the words "change of employer petition", it seems that one can use AP to travel and still after coming back he/she can file for either extension, amendment or transfer. This answers the main concern that I started this thread for.
Also, on other threads I read that its possible to file H1 amendement even if your H1 is still valid. This is one way to come back to H1 status and get a New I-94 card.
Some one also mentioned that if you have a valid I-797 extenstion approval notice and if you show that at POE to IO, he/she may issue an I-94 till expiry of I-797 (3 years) instead of AP (1 year).
I would appreciate input from others who have some knowledge or experience of above situations.

After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. You have summed it up correctly. Comprehensive insurance from a reputed US company/broker like AIG (not TATA-AIG) is the way to go. I had the same for my parents. Luckily, there was no need for us to use it but I know friends who have used it and were not left in soup (it worked as well as it was supposed to work).
Recently, one of my friend's dad came to Texas and got sick and the bill came to $60K. Unfortunatley, he did not buy travelers insurance and is fighting an uphill battle with the hospital.
My parents are coming next month, so I did a detailed research on all the insurance firms, both in India and in USA and I found that most of the ICICI or Tata-AIG plans have limited coverage, which limits the number of days in an ICU or visits by doctors etc.. Even if the plan has a $100K max, the plan may only cover upto $1000 per day for 30 days or so and then there is limitation for ICU and other surgeries. However, if you take a comprehensive coverage, then whatever the expenses, or wherever the charges are incurred, it does not matter. The total amount upto $100K will be covered and it does not limit ICU charges or room charges or doctor visits etc.
The only reason we need an insurance for parents is to cover emergencies, rather than regular doctor visits. Generally, any emergency run 60-70K, so I would recommend a minimum of $100K and do a comprehensive coverage. I have worked with IMG or check this guy at http://www.visitorshealthinsurance.com/
I even called IMG to ensure that this guy is an authorized re-seller/broker for the insurance.
Additionally, I did not find any insurance that covers pre-existing conditions. So just pray that they are healthy during their stay in US.
