Did it say anything on your online account about RFE when you received the email, or you just got the email i.e. when you click on the receipt number it shows status of the case which usually shows a generic message that the case was received and is pending, so did that message change?
If not, then did anybody else who got the RFE had that message changed?

I got a soft LUD on my 485 application on 3/26/2009 [first time since the original LUD.] Soft LUD on the spouse' 485 as well. Will post if there are any updates....

In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.

Like I said, I did not catch the whole speech, but from what I heard, he was not talking completely against it, he mentioned that businesses need more H1B's and should be able to hire foreign talent.
He was mainly against abuse by big consulting firms (he gave out a statistic that 20K of the H1B went for 8 or 9 of the top consulting firms or something like that).
At least there is something happening..... we have only two weeks....... this may be our only chance this year to attach anything EB

I know there are efforts towards state chapters, but are there any chapters based on big firms where EB2/EB3 seemed to be concentrated? Of course it wouldn't help to put up lnks from the front page as "cisco chapter", "oracle chapter" but at this crucial juncture it would help to encourage 'robust' people from such organizations to go on overdrive even if not web-publicized. just a thought.

one more is to freeze the accoutn for inactivity > 90 days.
I have been victim on more than 1 occasion for each of above tactics. Each time its annoyance ( writing letter. nothing gets done online), fees charged and increased blood pressure.
Unfortunately switching costs are high due to time taken to open new accounts and there is no guarantee that others are any better.
You are right. I was also a victim of account being frozen. It is really frustrating to see that your account has been frozen when you have to urgently send money. They do not even notify the customers before the account is frozen.
The replies that you get for your questions are standard replies or something which does not answer your questions. You have to go back and forth a couple of times to get your job done.
Glad to know that they are not a monopoly now and customers have more choices.

I don't think it is correct. There is no requirement in H1B to look for American first, if nobody found then sponsor for H1B. It is there in GC process for labor market check. H1B law is not having tougher provisions to not to misuse it. So, thats that reason, some are misusing. Its like Labor substitution. Previously, there is no law that says you shouldn't substitute labor, but now we have it. It is about changing H1B law to reduce fraud.
But as someone said, increasing H1B fees is not the way of controlling fraud. They should decrease the fees back to $360, just application fee, but correct the H1B law so that only people really need it will get the visas.
The intent of the H1B program is not to bring people in the country in "Anticipatory mode" as you put it. The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.

In this day and age the news travel fast and if we expose wrong people it will help everybody. My friend told me that his brother in law wanted to come to US to earn his flying licence. He wanted to go to this one school in California. My friend left three messages with the school last year buy luckily no one returned his call so his brother in law joined a school in GA. 1. Employer gave documentary evidence of a valid job for the candidate to secure H1B visa. The question of calling or not calling the candidate to come to US does not arise. The employer, by petitioning USCIS, admited that he wants to employ the candidate in US. The candidate does not need any further letter to come to US. All the required documents are already with the candidate when he goes for stamping.
Hence, it is valid for the candidate to come to US by presenting documentation.
1.1 Exception: If the Employer proactively cancels the H1B that changes everything, which I believe is not the situation here. (The candidate wouldn't even be able to enter US in that case.). Unless, the H1B is canceled, the employer is on the hook and not the candidate.
2. Payment for visa by candidate is not fraud on the part of the candidate if he had no intention. Although ignorance of the law is almost never an excuse, this is a grey area really. The candidate might have paid to the employer and not to USCIS for the petition. The actual responsibility to not take payment lies with the employer. My opinion: Candidate will not be held liable for this.
3. If Employer fails to provide paystubs or fails to put him on payroll, he is on the hook. He is liable for full wages as long as he does not cancel H1b (unless the H1B is transferred of course). He is also liable to pay return fare to the candidate.
IMHO, the candidate is cool. No issue. Go ahead with your complaint to DOL. Good luck to you. Come back to work for a genuine employer with a new stamp.

LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
Except IV all the other forums are in lawyer's websites. So without lawyers we won't get lot of useful info either. But I do see lot of activites in IV forums related to green card than others which is good we are growing on our own :D

Sending letters is a waste of time. I did many in the past and nothing happened. We will only make post office richer and lose money on postage. Nobody reads or replies to letters.

I know a lot of people using pre approved labor certs waiting for GC. What happens to them? I think this rule will affect only those who are trying to do Labor substitution in future.
