Doing things legal ways is just fine in most cases. But there are some times when you need to decide and treat people in a humane way.
A saying goes. "Headache pains are known to only those who have it and suffer." Somebody was arguing that scientifically delivery is just a natural phenomenon. But the pains and trauma can only be felt by a woman who delivers and there are circumstances when you are forced to be in shackes during delivery.

Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"

As gc_check explained, all EB2 with PD<2007/7 will get the green card 2 years earlier if this can be fixed. I do not understand why IV can not discuss it with USCIS.

No, I didn't go out of the country for stamping, coz i was under the impression that my visa was Change of Status from L-1 to H-1. Only now, i could find from the immigration lawyer that i don't have a valid I-94. My employer was napping too, all this while.

Do you or anyone who thinks that backlogs are due to labor substitution have any proof to claim so ?
Even if there were some, they definitely won't be in large numbers. First of all to use a sub labor, one labor had to become available. Do you think there were so many labors floating around to grab one ? I don't think so.

With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

I don't see big deal in this, just bit of information which has no consequences. Visa numbers do/will exhaust at some point in time.
so for real, how does it affect anyone?

Even if we put a 50% error margin thinking that there were more Eb3 labors, 140's are denied or downgraded to EB3 or a problem at 485 stage there are 1lakh - 485 applicants including Eb2 and EB3 waiting for 2004 and 2005. With a per country quota of 3800 + a bit of row how many years will it take to come to 2006 - where a lot of Eb2's are stuck?
I think it will take 10 years for a EB2 2006 applicant to get his physical green card including 485 waiting time etc.

Free speech means you can go start your own: oppose-interfile.org and no one will stop you. It does not mean that you can post whatever you want on any forum and people must leave it as-is.

Just couldn't believe how much the IO knows about. They are just so mechanical in actions and they do not even know the basic understanding of various bulletins. :mad:

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though

20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..

Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.
So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?

No, it is not always a 2 month gap. Normally RD (on your receipt), the data entry date (you see online as "your case was received on..."), and ND should be in quick succession. It was only in July/Aug 07 when due to high volumes many cases (including mine) waited for data entry for months, as no center wanted to accept that additional responsbility. Those whose cases were entered in July/Aug 07, became ahead of those whose cases were entered in Sept and Oct 07, no matter when they filed or what their RD (as on the receipt). People with PD in 2005 and 2006 who got GC last year were those lucky ones who cases were entered in the system in July, Aug (and may be some in Sept) 07.
