    2. Until the judgment goes against you or you run away, you do not need to worry about freezing bank account
    3. In worst case, during the judgment time they will consider your family, two kids. They are not heartless people and it�s just an accident. That guy must be insane to ask 3.25 million. I couldn�t believe the whiplash injury especially when the damage was <$1500. I just assume the impact must be very minimal.

    My advice is, don�t lose your hope and sleep. You insurance company is there with you to defend. Keep in touch with them and respond promptly to court notice or any letters. You do not need to withdraw your GC. Worst case if everything goes against you declare bankruptcy and leave the country legally. So if you want to come back in the future, you won�t have much problem.

    When you don�t have anything to lose�why do you worry. Keep it cool and every thing will be fine. Seems like those guys wanted to have retirement with your money.

    Dont Panic....

    I am sorry I disagree.

    1. The insurance company is not necessarily on your side. They will only pay up to the amount of liability that you are insured against and that too most insurance company will do reluctantly.
    2. It will be too late to transfer money out of the bank account after the judgement is passed. They will freeze your accounts when the case goes to trial. If you are going to transfer money do it before the trial.
    3. I agree 3 + million is absolutely unreal. Try and settle this before it goes to trial for a nominal amount.

    As always, thanks to IV leadership for their work and inspiration. I am curious to know IV's opinion on possibilities of legislative changes this year. I was more optimistic last December (2006), than I am today. Immigration reform is dead, and based on what I am hearing from some of the blogs, the chances for any legislation this year for skilled immigrants are bleak. After a lot of work in last two years, I have some opportunities to get into an alternative field of interest. The I-485 process (switched job and applied again in Nov 2006) now limits me from changing into a different field. After being in US for near 10 yrs, I have lost the appetite to continue putting everything at stake. My pessimism may be arising from my paticular situation, but I don't see any point in continuing to be in this country if I cannot switch to my field of interest for another 2-10 yrs.

    Ok. I agree with everything you say but you still haven't explained why EB-2 China hasn't moved. They never were Unavailable, which means they haven't used their quota but are still retrogressed. Why absolutely no relief for them? Not even a month forward movement?

    To be honest, I have no way to know why absolutely no change for China. There have been times earlier where India and China had similar cut out dates, then they changed dramatically, then India became unavailable, and now they are same again. With so much happening, I would say its very difficuilt to have a logical reason with no real data.

    All I can come up is that perhaps China might had a little higher demand than India in the last few months, or just that in case of spill overs, most visas might be consumed by countries most retrogressed, or perhaps DHS believes that the number of visas spill over would be only enough to cover EB2 Inida + EB2 china up to a certain date and China was already at that date, so if the demand is less than expected, then we will see movement in both India and China.

    Wish best for all Employment based filers. Hopefully some law change comes and justice is done to every one.

    I would hate to see different immigrant groups worrying about which group is getting ahead.

    Keep contributing to IV effort and hope no one need to go through extended wait times..........

    Dear Friends,

    Got Green cards and Welcome notices for me and my wife .
    Surprisingly no uscis e-mail and online status is still "initial review"

    Our journey in short :

    How long in US : 10+ years

    First Labor in 2002 . Changed job in three years before approval of labor
    Second Labor in 2004 . Approved in 2007
    Filed I140 and 485 - in July 2007

    Since then I was enjoying EAD / AP with no complain .

    I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
    From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
    My Lawyer told me that I can port to EB2 and it is a normal a process.

    1. New Perm
    a. Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
    b. Requirement : 4 years Engineering + 5 years minimum experience

    2. EB2 I140 (TSC)
    a. Filed in March - Premium Processing
    b. My Lawyer sent interfiling letter along with I140 filing
    c. Approved in 7 days (A# and Priority Date retained)
    d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
    e. No email and no updates on USCIS website

    Not sure about the USCIS and Lawyer fees . My company paid for every thing.
    Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

    Wish you all the best ......to everyone who is waiting for GC.

    I watched the whole debate, unfortunately ( as expected) they never touched on the question we voted on or the other most popular question about Katrina. There were other popular question too like NASA related stuff which never made it.

I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card.     I beg the max because I don't think we can do anything without the lobbying firm and other lobbying activities by core, and the contributions are < 20% of the money required. Please convince me that I should stop begging because !@#$%& or explain how to beg when we have < 3% contributing members in 45 days. In other words, please resolve the begging issue (by possibly explaing that we don't need the lobbying firm and/or other things). This is question 1.

    The following will be neglible if there is an implementable answer to question 1.

    He is un-comfortable because whenever he login to IV, he noticed that:
    - more than 40-50% respondents are talking about money/contributions & signatures showing how much they have contributed as of today,
    - 10-15% are talking about blocking non-contributors(calling by Free Lunchers etc..),

    The numbers in the following are low and the list is not complete. Lets assume the complete laundary list with higher numbers.

    - 5 % are Pseudo intellectuals (talking BIG but dont know immigration basics like - PD, issues of I-140/I485)
    - 5% are always trying to shutdown others, accusing/calling by names to other forum members (he says "Highly skilled" in accusing!!)

    Consider a retrogressed member X that uses the following quote to decide that Hill (with lobbying firm) and grassroot lobbying is important.

    Most people struggle with life balance simply because they haven't paid the price to decide what is really important to them.

    X again uses the above quote to decide the following. What are the arguments against this decision? This is question 2.

    Contribute financially and help in financial contributions from others so that we can lobby on the Hill, and
    Help with grass root lobbying (legislators + media), and
    Ignore the laundary list rather then expect everyone to meet X's requirements.

    The two questions are for everyone. Some members have gone over these issues a couple of times in the last 2 months. Please respond ONLY if you have an argument for question 1 and/or an argument for question 2.

    Is this situation only in Chennai consulate or in all consulates in general? I have not heard of any trouble at other consulates. I am taking an appointment this week and will choose a consulate that may work faster (Delhi or Cal).

    Any feed back will be appreciated.

    vfs received my passport today i.e., Dec 18th. Dec 6th 1400 hrs was the H1b appointment.

    Under PIMS, every consul must see information of an I-129 petition on the system before issuing a visa. As background information, we reproduce the following from an advisory on AILA Infonet:


    �Under PIMS, I-129 petitions requesting consular notification as the procedural benefit are sent to KCC (Kentucky Consular Center) after approval. KCC enters key data from the petition into PIMS and scans in key documents such as I-129 form, employer support letter, and identification documents of beneficiary. KCC also performs some database checks looking for evidence of fraud, violations, or other adverse history and records (including from SEVIS) and records its findings in PIMS. When a post is ready to grant a visa based on a petition (and apparently this includes derivatives), it must confirm the petition in PIMS before issuance. DOS knows that USCIS has not been sending change of status or extension of stay petitions to KCC at all, and we expect that interagency discussions are underway about changing that. We know also that even some consular notification petitions have not been sent to KCC. Any petition not sent to KCC will not show up in PIMS, and there may be other reasons why a petition sent to KCC does not show up in PIMS. When a post does not find a petition in PIMS, it must email to KCC, which unlike posts has direct access to USCIS' CLAIMS3 system where USCIS records petition approvals.     Mr. Aytes acknowledged that PIMS caught consuls by surprise. Every client must be warned of a wait of 2-4 working days before being issued a visa at an overseas consular post. It is likely that an I-129 petition filed as a change or extension of status will result in further delays as USCIS does not send information on those petitions to the KCC.

    So the conclusion is clear - go stand in line for a Z1. The documentation required is flimsy (some affidavits).

    It is not just wife's work permit problem. If you don't have GC and your kids are entering the college, they are not eligible for any scholarships are student loans. So you have to bear all the expenses from your pocket or you have to take a personal loan at a higher interest from some financial institution

    Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.

    As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
    Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.
