    Dear Friends,

    Got Green cards and Welcome notices for me and my wife .
    Surprisingly no uscis e-mail and online status is still "initial review"

    Our journey in short :

    How long in US : 10+ years

    First Labor in 2002 . Changed job in three years before approval of labor
    Second Labor in 2004 . Approved in 2007
    Filed I140 and 485 - in July 2007

    Since then I was enjoying EAD / AP with no complain .

    I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
    From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
    My Lawyer told me that I can port to EB2 and it is a normal a process.

    1. New Perm
    Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )

    2. EB2 I140 (TSC)
    a. Filed in March - Premium Processing
    b. My Lawyer sent interfiling letter along with I140 filing
    c. Approved in 7 days (A# and Priority Date retained)
    d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
    e. No email and no updates on USCIS website

    Not sure about the USCIS and Lawyer fees . My company paid for every thing.
    Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

    I know Aman has made a no. of trips to DC & these are not cheap.

    Let us all contribute to pay back all his trips .

    I am serious about it as people have no idea what people like Aman & others have done / sacrificed. If fact, we should authorize the Money Manager of IV to immediately release the entire amount Aman & others have spent since 19th December 2005.


    I am sure IV must have funds to handle this... if not, atleast start a part payment each month immediately


    I do not know, what is IV's internal procedure for these situations.

    Hi Ramba,

    Thanks for your response.

    I have few other questions based on your response please. I am considering BOTH the options and will act accordingly with the BETTER option.

    (1) EAD -To have the remaining of H1 as back up: If I use EAD and move to the new employer and also send AC21 documents to USCIS. My current employer will cancel H1 and revoke approved I-140. Also looking at the current scenario if USCIS denies 485 within a couple of months how do I get back to H1-B ASAP while I file MTR?

    (2) H1 - Maintain H1 and use AC21 with H1 transfer(I will have around 9-10 months of H1 remaining at this point of time): And if current employer cancels H1 and revokes I-140 and that triggers 485 denial, I will still have some H1 period remaining and this should aid me in CONTINUING the new JOB while I file MTR?

    1) You need to file a Change of status to H1
    2) Please see one of the links posted by me earlier (a link to Ron Gother's site) which says that if you get a H1 extension based on AOS and AOS is denied, you are NOT allowed to work on H1.

    It�s really a sad state for us, first the lawyer�s then the BEC delayed the cases, then the july fiasco.

    With a PD of 11/01 I am not sure porting to EB2 will be worth it specially with premium I-140 gone and the costs associated, ????? :(

    I am also in same boat. I have been keeping myself busy with studies, I was able to complete MBA and as well PMP. However, I would like to caution people on study front. Please give lots of thoughts on what do you want to study. One of the problem which I am facing after my MBA degree i.e. I am more frustrated being stuck in current position and doing something for which I am over qualified.
    I would be interested in knowing about prospect for folks like us in Aus. I would appreciate if someone on this thread provide some clues on Aus.
    I went to India couple of months back and there are lots of opportunities. But, I am not convinced if Indian market will be able to sustain this momentum over long period of time due to infrastructure problems and weak governments.

    Suppose you work for Company A on H-1B. You get out of the U.S. and come back with AP. You become parolee at that time. File an H-1B extension with Employer A, get new I-94 that indicates your status is now H-1B.

    6 months later, you get another job with Employer B. Since you already are on H-1B with Company A, you should be able to transfer your H-1B to Company B.

    mhtanim, appreciate your input. Though this sounds logical, I was wondering if there is any link to CIS memo or any other resource to check this? Even our company lawyer is not sure on this.

    What I said was just from logic. You are right... who knows how USCIS interprets this situation. However, I remember seeing one person in IV who has mentioned that he did this himself. If you really are planning to do this yourself, I would suggest that you do a paid consultation with Murthy or Rajiv Khanna.

    I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

    Logiclife, I am sorry you are wrong.You don't need to post hour by hour update, but the update you posted today on Aman's meetings , help people to understand what really IV is doing and are necessary atleast once a fortnight.I am sure you are working in a corporate world and drive projects.The first rule on driving a big project is status meetings once every week.This helps all the stakeholders.
    Pls attend our 'meetings' in order to get more information on what we are doing. Join your state chapter and actively participate in those 'meetings'. We called for volunteers last week for the media drive and only 12 members out of thousands of members that saw that message responded. We want to encourage members to actively help us rather than wait for update from us. Each one of us can create an update for the community. Meet your lawmakers and update us. A handful of people cannot do much. It is the collective effort of this organization that will help us get success.

    Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...".     I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.

    I think rpatel is right. This what I heard from one of my buddies who moved to Canada in 2003 and recently got PR.
    Canadian firms prefer Canadian work experience. This doesn't mean that your past experience doesn't count, just not that much

    Lets add more stories. As someone already suggested lets concentrate on how our GC can contribute to the economy - buying a house/establishing a company/etc. I also quoted some of the recent studies that showed how immigrant entrepreneurs positively contributed to the economy (couple links from IV).

Are you guys getting any kind of numbers back from paypal, on what is the kind of spike that you are seeing in terms of # of people contributing in the last few weeks?
