Why do people stay on H1 after getting EAD
1) Traditionally EAD was available to people who had a current PD, so staying on H1 for about an additional year did not matter much. But now if we have EAD and we need to wait for like 5 years to get the GC then the wait time is high enough for taking a calculated risk.
2) Cost is not an issue, if at all you'll save the cost of renewing H1 again and again.
3) I hear 485 rejections are very rare...I don't have any stats to back this point but seems like the reasons for rejections are such that a second application can't fix it. So if your 485 is rejected then you will never get a GC...again what benefit are you holding onto by staying in H1?
4) Do not forget that usually the attorney advising you to stay on H1 is also the one who will renew the H1, so there is a vested interest in his advise. I am not suggesting that they are necessarily giving out bad advise, just that we should not forget where that advise is coming from.
My take is that if you see a substantial change in your situation (>25% salary advantage, Starting own company etc) then you should go for using EAD. On the other hand if you have H4 Kids in school, have a house here or for any other reason not willing to take a small chance about the possibility of having to go back to the home country then you should just stay on H1.

AC21 is a law but certain provisions of AC21 have been introduced in separate memos.
Job portability under AC21 is also part of a guidance / memo - so if any AC21 case goes for hearing in an immigration court, any change of employers while 485 is pending is considered illegal. This is not very common though.

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.
Yes it is unfair in some ways. Couple of my very close friends (who are also colleagues) --one is of Lebanese Origin, raised in Dubai, and the other, Taiwanese Origin, raised in Uruguay. They are in similar Finance positions as I (though I am a step senior) had the entire process, from the PERM, to card delivery, completed in 11 and 7 months, respectively. Whilst I am waiting the last 5+ years. It can get you down at times, and feels like living in a constant state of "temporariness". However life does go on :)

The American Immigration Lawyers Association (AILA) has a Business Litigation Committee (BLC) and we met this week and the hot topic of discussion was the recently released Neufeld memo. There is a strong belief that the memo was issued in violation of the Administrative Procedures Act. There is also the belief that the memo violates long-standing precedent and established law. It is believed that there are numerous industry groups as well as individual companies that may be pursuing litigation on this matter. The BLC is in the process of working with the American Immigration Council to create a special section within its clearinghouse service http://www.legalactioncenter.org/litigation-clearinghouse (http://www.h1cap.com/blocked::http://www.legalactioncenter.org/litigation-clearinghouse) specifically dedicated to collecting and posting relevant documents and information on this issue. This will allow all interested parties to be kept up to date on efforts being made to address this policy. We will then organize the relevant documentation and make it available for access by others. Same situation happened to myfather. He attenede visitor visa interview. VO told him that he will be getting passport in a week. But we waited for more than 10 days. When we checked online status, address in VFS was wrong. So it went to wrong address.
Call VFS customer service. customer service is really good.They can help you to get the passport to ur correct address.

(I 797) has an expiry date of April, 2008. However I do not have a stamp on my passport reflecting the expiry on April, 2008. The only H1B stamp on my passport was that obtained just before my first entry to the U.S on a H1B and the expiry date shows June,2005. I didn't have to leave the country since my entry date and hence didn't find the need to get the visa (current approval) stamped on my passport.
Since one can apply for a H1B extension 6 months before the actual expiry date which will be November 2007 in my case and if I do so and obtain a new approval notice (with an extension of upto 3 years as I have a I 140 approved with my current employer) and if that notice has an expiry of April 2011, then if I go to the Canadian US embassy in Jan, 2008 to get my H1B stamping done in the month of January, 2008, will the new stamp have an expiry date of April, 2008 (current approval notice) or can I get a stamp valid until April, 2011 (based on latest approval notice)?
Your help is highly appreciated.

You can go to FORUM and click on NEW THREAD and enter an appropriate title and then enter your query.

To put it in other words...lets say u r very hungry and go in a restaurant....Just bcoz you r very hungry you don't start to eat from somebody else's plate....you would take ur own seat SEPARATELY and order your own food.....Think of posting query's in the forumn similar to that....And that goes for everyone else hijacking somebody else's threads..
