Your company is not a sample of the entire population. The H1B program is not on-demand program. It is once in an year annual event (because of the demand). US based companies when they get a new project which needs a position, if they cannot hire locally, cannot get H1B worker from overseas when they want. So, in anticipatory mode they have to get some numbers and utilize them and we do lose some H1B visas if they cannot bring them for various reasons.
Is it fair, may not be. Is it widespread waste, I don't think so.

The intent of the H1B program had always been for US employers to hire foreign skilled workers "On-Demand" when no american is willing, qualified or able to do the said job. Prior to 1999, the visa cap was 65000/yr WITHOUT the extra master's degree cap we have now, and still visas were never totally used up for any year, certainly not on the first day. It is only after the advent of the IT consulting companies hoarding visas in "anticipation" of future jobs that the problems started. Without any restrictions on this kind of abuse, no amount of H1 visa increase would be sufficient. They are talking of raising visas to 130,000 right? Based on the FY 2008 applications, those visas would be used up in TWO DAYS!
IMHO, the intent of the H1B program is equally important than just loopholes (or not) in the letter of the law.

:) wait till september, i betting we will see 25-28k eb2 approvals, good for them i guess. it is typical with USCIS, towards the end of the year they wake up and go overtime in approving the cases.

USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

answer with complete honesty, if YOU got your green card today, would YOU ever be involved in IV again? except maybe when you want some answers during your naturalization stage?

I disagree. It all depends on attitude. IV is an organization "for the members", "By the members". If your attitude is "I will get on IV JUST because I WANT something" and "If I got it, I don't care" and "If I have questions during naturalization stage, I will get back on IV" may not mean that you have a great life or enjoy life after GC. Life after GC is not that rosy as you think. Big companies - hiring is the same for GC/h1b so u will not have preference. If you are independent and want to do something on ur own - it is not easy either - it is more stressful and challenging - this is life my friend, 95% of startups fail and these people are seen nowhere after that. Very few people are successful and that too with a lot of difficulties, hard work and faith. The "enjoy life" after GC is generally not U but your next generation (children) will bear the fruits. they will enjoy all the freedom and comforts until reality hits them in form of career and family life - this is something everyone faces.
A lot of people love to be on IV - say, if someone has answered someone's question on IV and the person is benefitted - thie person is extremely happy for the other person.
A lot of people who are active actually love and are passionate about what they are doing. Lot of people want to do their 2 cents or more - this is what this organization is all about.
Over the past 2 years of my association with IV - I have seen a lot of stones turning soft, a lot of people who never wanted to get in, are now very active and highly motivated.
So it all depends on attitude.

My wife couldn't do TB test since she was pregnant when we filed I-485 in Aug 2007. Now she is in India and be back only in the first week of June. If we receive an RFE for her TB test ( my PD is EB3-I Oct 2003), can we request an extension for RFE? Is that possible?

My fear came true today. USCIS issued a RFE for my wife's I-485 TB test and she is in India right now. RFE has May 6th deadline and she would be back on June 3rd.
What are our options?

Pre-pone her trip? (this would be really a costly option for us...since we have so much planned around that date)
Do TB test in USCIS approved surgeons in india (If there is any)

Sometimes the employee's hands are not clean either - they would have falsified the credentials and the employer takes advantage of that fact. The employee complains here that his employer is "blood-sucking" monster in human form.
As I said this happens sometimes, not all times, and certainly I am not suggesting all employers are good. So please dont flame me.
I support this discussion of how to get back at bad employers.
That is right. There are people knowingly get into dirty deals with employers like
(1) Faking experience
(2) Working out per diems in percentages
(3) Changing job titles to suit their needs
(4) Most important - employee tries to do what he/she can to keep employer happy as the green card petition is filed - I have seen this - people I know do this - they lick the boots of their employer - get coworkers fired so that their jobs are secure - get personal in alomost everything with employer so that they feel secure and job satisfied - These are the people who come out anonymously and talk bad bad things about their employer because they know they are into a screwed up relationship - no pay hikes, employer cheating on perdiems - employer knows employee is ass kissing and talks sweet but exploits - employee knows that things are not going to be the same for a prollonged period - puts a false mask and blames organizations like IV for not doing anything - these are the folks who encourage employers to do what they want to do.
