There are several of us who have advanced degrees and yet have been put under EB3. Now, a lot of them can move on to a more responsible role but held captive by the immigration situation.
Just a thought - if the STEM degree holders can be exempt, then it will take some weight off the entire system.

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.
I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.
I need to clarify a few things before i nail these blood suckers
1. How long before i board my flight back home , should i send the documents to DOL
2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
or copy to send to DOL
3. What other documents should i send alongwith

That is the way the USCIS is interpreting the laws and actually doing it that way...There are two different caps applied to you....The EB2 cap of wharever numbers available and the country cap of 7% for all of china EB+FB combined together.......It is true that there are more EB2 numbers available...But as the country quota for CHINA/India is over they are flowing to EB3 ROW instead of flowing horizontally to EB2 china....There is a big discussion about how this flow occurs and if it is fair or not...The title of that thread is 'Unused visas' Reading that would be helpful to you...

If it works the way it says, the EB-2 quota stay at EB-2 for oversubscribed country, then why there's no movement for EB-2 China? Something is not right.

This is pure speculation on my part, but if CIS is returning visa numbers and there are now some visas available, it seems like it would make more sense for DOS to just make the returned visas available in the August bulletin, rather than flip flop on July once again.
I think that is what they will do in order not to look like fools.
the question is, What happens to those july filers whose applications have not been returned yet and who will become current in the next bulletin.
Will USCIS ask them for the new fees.... Will they have to do all paperwork again including medicals.....what a mess!

In this day and age the news travel fast and if we expose wrong people it will help everybody. My friend told me that his brother in law wanted to come to US to earn his flying licence. He wanted to go to this one school in California. My friend left three messages with the school last year buy luckily no one returned his call so his brother in law joined a school in GA. soft Lud on mine and my dependant on 2/10/09 and there was second soft LUD on mine 2/27/09, till now no RFE, what does it mean, does it mean everything is fine and they do not need from our end.

Quantitative Financial Economics, 2nd Edition Cuthbertson

Since IV has contact e-mails for all its members, it can also send periodic e-mails on its activities, funding drives, recent achievements and ask for the members to contibute. This will be helpful for those who dont visit the site very often. For Example, recent update given by pappu inspired me to sign up for monthly contribution. But that would happen only if i visited the site very often. I would have missed it if i am not a regular visitor to the site.

As far as I know from friends who have had similar case in the past, yours is not at all an uncommon situation. My belief is that use of PO Box on physical address helps to get documents re-directed to their correct department. Absence of same means that the personnel in charge have to "think" where to re-direct and nothing more than that. Again this is based on what I know from reliable friends.
