Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

I am bumping this old thread since I might have missed something in this discussion.
Some advantages of staying on H1 stated earlier were:
For me:
(2) is invalid (Already married, wife on independent visa)
(3) don't know (Heard it's more flexible now, so willing to take this risk)
(4) USICS started issuing 2 year EAD, so the difference is only 1 year additional extension with H1 (Not a problem for me personally)
(5) is invalid (Most of us renew EADs even if we dont use them)
which brings me to (1). How does having H1 give peace of mind? Hypothetically, if 485 is denied and H1 was extended beyond 6 years based on a pending AOS, is it still valid during MTR/Appeal? If it is, since EAD doesn't provide this privelege, I think this is the only reason why people should stay on H1?

These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option. That is not true. In fact I would say that many people who leave have lot of guts. they may have other priorities like family, social etc. I know many naturalized US citizens who have sold their homes and are / about to go back. some IITians left because of green card issues (one of my friend tried to apply ..company was laying off H1B's ..he moved to NY financial company and now is in India at higher post. in the end it is priorities that you have in life.

Hello All,
How long does it take for decision after NSC has recieved I140 RFE response. My RFE was for my Employer Ability to pay i.e tax and bank documents etc.
Please see my details in the signature.
Is it worthwhile to convert my I140 to PP ? Will this expediete the whole process ? My I-140/I-485 are already current and NSC processing date mentions that they are already processing cases filed after me....
Any advice or suggestions would be greatly apprcieted.

If PD is not current, they cannot accept the application, the just have to return the applications citing the same reason. If they accept the application they have to receipt it and if they reject, then they need to have qualified reasons for it... Not having available visas is not an acceptable reason to reject the receipted applications. It goes to shelves untill visa number becomes available... Note. if they receipt, they need to process EAD/AP and work on the application like any other.

The validity of the filing is determined in the initial processing; and initial processing is complete only if you receive a receipt notice or you get your packet back. Currently, June Filers who filed mid-month are getting their receipts which means we will know our fate only probably by the end of month or even later. keep your fingers crossed.

It appears that the policy was always this, but since there were no excess Eb1 in the last couple of years, there was no spillovers in the last 2 years, howeever this year there are higher number of unused EB1.
In fact the way it appears is :
EB4 unused ==> spills over to ==> EB1
EB5 unused ==> spills over to ==> EB1
EB1 unused ==> spills over to ==> EB2 world wide.
EB2 Worldwide unused ==> spills over to EB retrogressed.
So before any spill over to EB3, visas are given to EB2 category.
Since the unused EB2 visas are given to retrogressed countries, I believe that more visas are used by country that has more retrogression. But if there is any future movement in EB2, than both India and China could experience it.

LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
