My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.
please advice.

I don't think we are not hearing news from IV. The Admin fixes campaign has been the most important effort these days. So now we all need to give IV an update if we sent our letters. I would not care about core members who were old and new. I really dont care about them because I think IV is all of us and not core folks. I just care about if IV is doing good work and helping everyone.
Why would you be curious to know about someone else's personal problems/issues? Your post sounds more like my daughter hypothetically saying that she doesn't care about whether her grandparents/parents are alive or dead, as long as she is there and she has a family to feed and take care of her...

I do beg to differ, nice post but low on facts, its more conjecture and assumptions.
PHDs - EB1 dont make the kind of cash you have shown (ask the post docs who are working there asses off), similarly EB 3's are not restricted to the range you are talking about.
Gaming the system is what screwed us, its not just EB3 its every where. The ones who gamed the system already have their GCs. The extent of gaming in EB1 and EB2 was more than EB3 (ask a lawyer, off the record and you will know). Bodyshopping companies send every one as project managers and they apply in EB2. as for experience, lets not get into that, it is very subjective and vague. I could go on and on...but my level of frusturation with USCIS is too high...hoping and praying is also not an option these days.

How about the following:
Some IO was just playing around at MySQL database prompt. Just browsing without modifying any data... but it was recorded as LUD.
They were training new IO's and showing them some old applications as examples. And it registered as fresh LUD's.
They were performing data-mining/archiving on some old apps...I say, unless and until you receive a letter from them, just chill and get back to worrying about retrogression :-)

If your file is being touched by an IO or if there is a system wide update, that date will change.
How do I find out if there has been a Soft LUD? I have an online account on uscis.gov and the "Last Updated" fields are all in 2007 (when I filed my AOS).

I dont think they will stamp like that...If you show only AP they stamp I-94 based on its expiry says AOS pending or If you show only H1-B visa on PP they stamp I-94 based on Visa expire date..
But showing both at POE doesn't not give any value and also it might confuses IO..

Meanwhile, my lawyer today emailed & confirmed that the h1b will be valid even after using AP to travel and one can also renew or transfer the h1b. Even after the current I-94 expires obtained using AP, if one has still valid EAD or H1B I-797, he/she will be in status. However she also said that this is tricky situation and she could not find any CIS memo.
HOPE THIS WILL STILL SOLVE MANY PEOPLE'S DOUBTS.
Now I see no reason why anyone should NOT use AP to travel. Why should ANYONE waste money and time for restamping and take a small chance???
However as "Ramba" said in post# 27, it is still a small chance as no one knows what is exactly the CIS rules.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV).
