Hello everybody,
I'm a new member and i joined this forum today because i'm stuck in a knot. I am a Master's Student and i'll be graduating this May 2007. I have applied for my OPT which will start from 04 Jun 2007 and will end by 04june 2008. Now the next day after i sent my OPT forms to the immigration i read the news about the H1 general quota being filled already on the first day. I am really confused now.
Here is where i need your help, any prediction or idea when the Master's quota would be filled this year? Is there any way (website or something) that we can keep trck of the number of H1 application vacancies available in the Master's quota.?? Till what date so you think i should have a company file my H1 if i have to get into the MAster's quota this year?
These are the three questions that i seek the answers for...

I appreciate your enthusisam to respond to most of the negetive comments and thats a good thing. Try to contain yourself sometimes...otherwise people might just ignore you as another loud mouth.
ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

I joined a small company right after graduating from a university in the US with a masters degree. At the time of joining, I was told orally that my GC will be processed in a timely manner. Being naive and timid, I did not press the issue and months became years before the employer agreed to file my labor after work for the company for 5 years (1 year of OPT right after school + 4 years of MS). Although I work in high-tech and would have qualified for RIR, the company lawyer convinced me to apply using the traditional route promising the entire process would take two years. Once again, being naive I agreed. Now, I am on my 8th year with the same company with my labor stuck in BEC, and no relief in sight. I can look forward to years more in the same position and same company! Sadly, though I am highly respected senior member of the company (in terms of knowledge and time with the company), people who joined after me and were trained by me, have gone on to Managerial positions, while I can only sit and watch.
I do not blame anyone or anything for my predicament, except my naivety. At least, I am glad for sources of information such as immigrationvoice, immigrationportal and immigration-law that have helped me immensely with my education on all matters immigration. Now, I feel I know more than my lawyer and cannot be convinced to take foolish decisions. So, it gladdens my heart to see that we in immigrationvoice seem to be having some impact on the lawmakers as it feels like I finally have control over changing my status quo.

Hi All,
I recently had my last name added on my Passport. I just submitted for updating the SSN. Couple of questions:
1. Does anybody know if I need to run the payroll and also file the taxes with new name on the SSN once it's been updated. I still need to file my 2009 taxes.
2. Do I need to inform USCIS about this or it should be OK if I just submit the new name on I-129 when I apply for renewal later this year.
3. I maintain H1B expiring Sept 2010. I might need to travel to India before expiration with the current visa. Do I need to do anything to avoid name confusion at POE?
Please share your experience. Appreciate your time.

I am starting to see a trend in the receipt notices.
Some of the people reporting getting recepit notices this week (yesterday and today) have LUDs of 07/28/07. My thinking is that This week will see receipt notices for everyone with an LUD of 07/28/07
HOPEFULLY next week will see receipt notices for 08/05/2008. This is just my observation.
People please post your LUDs for your I-140, the service center AND how your receipt numbers start (SRC vs LIN) each time you post a receipt notice.
Can you let us know how to access LUD from USCIS after login? I think many will appreciate if you do so

yep..very few care about EB, its all EB2 these days, one of the reasons i am very close to giving up, difficult to convince people these days. I am guessing that most EB3 I's have simply given up or have been bulldozed aside. We know for a fact that there are thousands in a similar situation, but they don't seem/want or care to voice their opinions.
I tend to agree.... nowhere in the past discussions IV seem to have cared about EB3s. It is more frustrating to see this situation sincce Eb3's have been suffering for longer with no hopes what so ever.
And anyone trying to implicate that EB3s are less skilled are plain wrong - we got in EB3 limbo due to large corporations doing things by book (or for plain long term commitment out of workers).
Either way, IV leadership needs to re-iterate and re-emphasize at least once that this is not EB2 fight only but EB fight in general. IV discussions simply have gone EB2 biased only for too long.

USCIS will continue to monitor these filings.
That means - US-MS petitions on and before APril 9 are safe and USCIS is still accepting US-MS applications

If we add up the 119K and 13K (masters) it is around 132K. if they have received only one application per packet, the counting is almost over except for the 1000 odd applications and the masters cap is wide open as Mr Oh said. It would have been good if they said how many packets still need to be processed.

The petition looks great! I'm languishing in the queue since March 02 (PD early 2002). No IO is willing to listen to anything about my case. Sometimes I hink we should meet up with USCIS director and explain how unfair the whole system works and how individual cases have suffered!

The aim of this appeal is not to compare or compete with EB1, PhDs, US MS degree holders or discuss other exotic bills!
There are several hundred EB2 / EB3 folks who have continued to live here for several years (many have crossed 10 years). They are stuck in the infinitely long GC line, for no fault of theirs. It is natural that people who have stayed for long have grown up children (who are not US born) and who need to go to a good college for a good future.
It is almost impossible to pay international fees and it is neither fair no appropriate to break the back of genuine law abiding residents, despite the fact that they have lived for
8 / 10 years and have sincerely paid the taxes due to the government, just because they do not have a GC.
For the "sin" of being Indian/ Chinese born and for the "sin" of not being able to get the GC because the rules favour long term indentured labour, an entire upcoming yonger generation should not be allowed to suffer. This is unfair and discriminatory. If any one of us had been from a country other than India and China, we would have obtained out GCs in 3 / 4 years.
The idea is to have the cases of all genuine, hard working, EB2 / EB3 employees who have honestly lived here and are continuing to process the path ot GC legally, be considered from the human angle, more so from the point of view of the education of the children.
When it comes to illegals, people scream about human values, humanitarian considerations, education of their children, family ties etc etc. What about us, who have followed the rules "to the T" ????
Is following the rules, going through the approval complex web of approval processes, paying taxes and trying to lead sedate and simple lives a sin?
Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars!
So friends, let us be clear in where we stand and what we are pleading for.
Unless we have the conviction and clarity we cannot make any progess!
