Hello,
I'm currently holding H4 Visa and I'm completing my MS degree in June 2007. Am I eligible to apply in Advanced degree (or Master's degree) quota for H1 visa once I graduate?
I want to know if one has to be in F1 visa to apply in this category? Please help...

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

My GC process was started in 2001, my labor was approved in 2003 but since my company was closing the branch office where I worked, I had to move to the main office which was in a different state. Due to this my approved labor went down the drain. I moved to the state of the head office, meanwhile my company off-shored a major portion of the development office where I was working early 2005. After much persuasion from me the filed again but I had to either move offshore or take up a 90% travel job with the same company. Now, I travel and am away from my family during the weekdays. I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?
With the retrogression my GC could take years....sometimes I wonder if the stress, living in constant fear not knowing what is going to happen tomorrow, staying far away from loved ones, all these sacrifices is really worth it when legal workers like me who have contributed to the economy of America seem to have no value in this country.
Ragz4u if the above person process his labor application prior to april 2001 he should be qualified for 245(i).

I don't think you have waited for 6 years after your PD to be able to file for EAD/AOS Benefits... the whole thing is messed up... There are people who filed during July Bulletin Fiasco and there are who could not even though their PDs are before yours. So do you ask them to SHUT UP ?
Everybody waited for a fair time before they got there EAD's. None of us got the EAD on day one. So don't try to mix all the issues into one.
I support this initivative.

A lot of people have already sent the flowers and they do not follow the IV nor do they care about polling here.
I think the idea is catching up very fast thru email chains and people are doing this independently
So we will never know, exactly how many people really sent the flower, but still the effect is the same !!!

Yup. Make a group, pool the contributions. One member collects the money after making $100 pay pal, google contribution. This concept can be extended to $200 , $500 too, if you can form big enough groups.

Why do I have to hand out flyers to complete strangers when 10000 visit the site everyday??

I think he is telling the truth. Otherwise we would have almost 100% attendance for the rally. But it does not seem like. So, i think we "so called higly educated and qualified" need to think about it.

abolish per country limits on EB visas will back fire us because of diversity issue. We should propose some thing where there is no controversy to reject and that's is recapture 200K visas and EAD/APO for 3 years

Our contacts in Washington have told us that there is a growing chance of a bill to recapture as many as 90,000 visas. The language of the draft bill that we've seen calls for a full recapture of the unused visas from 2000-04.
EVERYONE should contact their Congressman and let them know just how important this is.

yep..very few care about EB, its all EB2 these days, one of the reasons i am very close to giving up, difficult to convince people these days. I am guessing that most EB3 I's have simply given up or have been bulldozed aside. We know for a fact that there are thousands in a similar situation, but they dont seem/want or care to voice their opinions.
I see that the above discussion keeps on going on about EB-2 only. Doesn't anyone at IV care about EB-3 I also . I am sure there are a few EB-3 I people at IV who are suffering from retrogression , myself included.

1. If USCIS get <= 20k on April 1 (sunday), 2 and 3, all US-MS petitions are guaranteed to be at least processed ??
2. If UCSIS get > 20k on April 1 (sunday), 2 and 3, then i guess, all 20k+ numbers with receipt date including that date when USCIS officially announce H1B-US_MS cap reached, will be under random lotter??

Every Joe Schmuck can start a company; it takes only few hundred dollars. And by the way, those were supposed to be my dollars.
Having said that, I would like to remind the readers I have great respect for those with leadership qualities. Now, my questions to all, what percentage of green card aspirants start such companies?
Just 1%, what about the remaining masses, they in my mind are parasites, sloths, cowards and will do more harm than good to our society.

I was just thinking and then this came up on me . How about sending a poster along with the letter campaign. I can contribute atleast four posters. They do not have to be full size posters ..can be just A4 size pamphlets kinds. We can just print them in color printer and send them along with the letters. These posters may make it to the press also as they will be funny and spicy for news. Actually, we can send copy of our letters to press as well along with our posters. If we make about 10 such posters, we can send one random poster along with the letter.

Also, there is something I wanted to ask I was looking at our I 797C (I485 receipt notice) and found that the Priority date cell is blank. I have checked another I-797 (I-140 approval notice) and it is mentioned there though. Is this common ?
Yes, PD has no significance until case is ripe for final adjudication. Sometimes they don't care, as it has to be filled in manually. When I got my GC (a few months ago), the approval notice I received had every date cell (including PD cell) filled with the date of my final approval. It didn't make any sense, but it didn't matter.
