I completed my MS in Computer Science from US around 6 years back, was on OPT for a year & thereafter moved out of US & came back to my home town. Have been working here for 6 years now in the software field & have now applied for H1B under masters Quota. Was wondering if I am eligible to apply under this quota as I am neither a fresh masters graduate nor have any status in the US. Also, my lawyer has only filled out the I-129 form. Is there any special form that needs to be filled out to be considered for Master's quota?

No green card for you. Just work well for 6 years, enjoy life in US, enjoy sports cars by renting, not by buying, rent a big house, have a lawn and garden in back yard, grow your own vegetables. Have nice vacations like Hawaii, Jamaican islands, Vegas, Porto Rico etc.,Have fun in life. Do not go for green card. On March 12, 2002, the House passed such an extension. Section
245(i) of the Immigration and Nationality Act was first enacted as a temporary
provision in 1994 and has been extended several times since then. It enables

No cap would be the best solution... but that is very tough to sell in Washington....That's why all this complications of asking to take dependents out of the cap and allowing overflow to go to China/India...
As I understand, IV already made these arguments to senators and even the senators who are sympathetic to immigration are not willing to remove the cap..The only thing they would accept is that the overflow would go to India/China/oversubscribed countries....I wonder if one of the core members would comment on this.....You do not need to name names....Just a request give a description of your interactions with law makers in this regard...That would put this issue to rest.....

If in 25 yrs time, someone who would bring skills that improve America's economic competitiveness and strengthens this country's overall quality of life is being brought here by a Lear jet, why would I crib over that, saying I only came in first class? so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?

Thanks Ragz4u. We shud try and publish info like this on the website in an "Recent Updates/Activity" section. That section will give not only what IV is doing currently but also what the impact is. Now i dont know if that will have adverse consequences, but if it wont then we shud publish more such info on the site. This will convince the fence sitters to contribute and participate more actively. We have the forums on the extreme right, above or below that we shud have a "Live/Recent Updates/Activity" or a link updated as frequently as possible. There was a saying that "IV never sleeps". I think it is time that the people visiting IV and it's forums know that and know what all is going on.
Does that sound like a good idea, or is it going to have adverse effects?

My I-485 was recieved on 7/3/07.
140 was approved 6/2006 by TSC. See a LUD on 7/28/07.
My 485 was sent to NSC.
Still waiting for reciepts/cashed checks.

I sent out an email about IV and this thread to my family and friends today and One of my friend called and said he will make a contribution. so let's see. I have posted about this thread on the Southern California Yahoo groups and sent emails to some IV members I have met recently. so we will see how this turns out. My thought is to keep this thread active throughout the Holidays season. We have 6 weeks to go this year and 23,000 members. Let's see how much we can raise in this time frame.
At one of the booths we had in Southern California a couple of weeks ago a gentleman happened to stop by and said "your orgnization is so strong you can raise funds easily because it only takes every member in your group to contribute 10$ and you will have close to 250k in funds in no time". If it's that easy my dream will definately come true :confused:

I believe if the case has been pre-adjudicated then it shouldn't matter whats the RD and ND. They will probably approve based on Priority date. Earlier PDs get approved first. But who knows, its USCIS.
dwuser's case does not seem to have been preadjudicated, as his/her ND is not within the published current processing dates by TSC. For preadjudicated cases PD should be the priority for visa issues.

Anyway fair and common sense are words that do not exist in USCIS dictionaries. Belief, faith and supporting IV is perspective too. All these entities do not last without results
