Strange really strange....I am sure RD/ND had not move back and forth so those who applied in late 2007 or 2008....did get approved even though their RD/ND was not current....What nonsense is this...
Now the other thing to worry is FP notice...mine is beyond 15 months and I am sure many are in the same boat....so the wait is longer.....FP and then again NC/BC.....what the &*#$

The above part of your submission is not true. If you read the I-485 Adjudicator's Manual, you will find that the file is already opened and input into the system at this stage. Otherwise dwhuser would not have received I-797 Notice of Action.
In theory action on a case should be sequenced by priority date and then received date within the priority date batch. However, nobody knows for sure how USCIS works each case.
In the above scenario notice date acts as the receipt date and the received date mentioned on the I 797C is just a mail received date. I just called Customer service and confirmed that a receipt number is issued to an application on the notice date and mentioned on the case status. Hmm...that puts us in a backseat. Although we are officially current on priority date, technically it doesn't apply and we will have to let it pass and wait for... who knows another year :rolleyes:
Also, there is something I wanted to ask I was looking at our I 797C (I485 receipt notice) and found that the Priority date cell is blank. I have checked another I-797 (I-140 approval notice) and it is mentioned there though. Is this common ?

Congratulations Fred!
My PD is 4/30/04 and I am anxiously waiting as well (since 2001 actually).
This is not an accusation on Fred in any way, but I just noticed that his Notice Date is 10/3/07, when the current processing dates for TSC are 8/23/07 - so this is yet another mystery of USCIS/TSC, one I doubt we will be able to solve anytime soon.

A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? Socio-economic solution along with a sensible immigration policy has been found to be far more sensible as compared to a pure enforcement policy. It has been proved over the years that a pure enforcement policy which many nativists support to be economically unviable. Minutemen patrolling the borders to Gov. Perry's multi million dollar border cameras, have proven to be ineffective and economically unfeasible.

Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.
I asked my lawyer abouT this and she said that in a recent AILA liasion meeting, TSC told AILA that they now have an "automatic sweep" process to determine which applicants have current PDs and therefore this email process is no longer required. Has anyone else heard the same?

i guess with more EB3 folks moving to EB2, it will help those of us who are stuck with no option to move to EB2. :)
i think they need to make a rule where if you are stuck more than 5 years due to retrogression, all over flow visas need to be first given to those folks in the order of PD.

I joined IV only this month due to the July visa fiasco. I learned a lot from all the members and the IV core team. I haven't made any contribution so far. My husband who has a H4 visa just recently graduated from nursing school and finances are tight. Anyway, with this new development, hopefully my husband will be able to get a job with his EAD. We will be in a position to contribute to IV. Thank you again!!!

The idea is interesting, but I am not convinced. I am a skeptic. Becacuse the question is how will anyone be able to make this idea into reality. Someone should manage a timeplan, budget for this bill. We also need few people to go to Capitol and talk to media and Senators. We need someone to become a leader of this idea. Without a leader and timeplan I cannot buy this idea.

Received receipt notice on 30/04/2007 which mentioned RFE mailed on 30/04/2007, however till date the lawyers have received nothing, does it take that long for the RFE to reach the lawyers??? its already been 13 days...Please respond...

I equate the situation to a person who sneaks into your house at night and in the morning demands that you respect his human rights and provide him with food and water. No one would tolerate that, yet some how some people think thats ok when it comes to the countries borders.
The church encourages it as most of the illegals are catholics. Poor and illeterate people are usually more likely to attend church and contributes to the churches influence. Believe me, were the Mexicans muslims, Jews or Hindus the church wouldnt care and would probably oppose it. The mosques and temples on the other hand might step in..............

I joined a small company right after graduating from a university in the US with a masters degree. At the time of joining, I was told orally that my GC will be processed in a timely manner. Being naive and timid, I did not press the issue and months became years before the employer agreed to file my labor after work for the company for 5 years (1 year of OPT right after school + 4 years of MS). Although I work in high-tech and would have qualified for RIR, the company lawyer convinced me to apply using the traditional route promising the entire process would take two years. Once again, being naive I agreed. Now, I am on my 8th year with the same company with my labor stuck in BEC, and no relief in sight. I can look forward to years more in the same position and same company! Sadly, though I am highly respected senior member of the company (in terms of knowledge and time with the company), people who joined after me and were trained by me, have gone on to Managerial positions, while I can only sit and watch.
I do not blame anyone or anything for my predicament, except my naivety. At least, I am glad for sources of information such as immigrationvoice, immigrationportal and immigration-law that have helped me immensely with my education on all matters immigration. Now, I feel I know more than my lawyer and cannot be convinced to take foolish decisions. So, it gladdens my heart to see that we in immigrationvoice seem to be having some impact on the lawmakers as it feels like I finally have control over changing my status quo.

If everyone who is aware of this website : 7000 registered gives 20 per month, its 140,000 a month.
140,000 a month would be MORE MONEY spent by all of the guys working against us : Numbersusa, FAIR, ALIPAC etc.
We can blow them out of the water if all of us can do what a few are doing.
However, that is not happening, to the delight of NUMBERSUSA.
