On my 485 receipt, I have RD as 7/20/07, ND as 9/13/07. But when I check my case online, it has 9/12/07.

I had called TSC yesterday and the rep kept telling 9/12/07 and TSC is processing 8/30/07. I told her I have the original receipt in front of me and it says 7/20/07 and not sure where you are getting 9/12 from. She said "Oh I am sorry, I was looking at the incorrect place". She later gave me a SR # and took all the info. The funny part was she even refused to open a SR telling the date was 9/12.

Not sure whether opening a SR now will help but trying does not hurt and it is FREE !!!! Hopefully the officer looks at my file and then approves it.

If you look at my previous posts on this thread, you will get clear picture of what happens. TSC did receive your application on 9/12/07, although USCIS received it on 7/20/07. They entered your data on 9/12/07, and sent out notice the next day. For the two months, it was perhaps lying somewhere with several thousand other applications no one wanted to accept. Mine was received on 7/2/2007, but entered in the system on 10/11/2007.

TSC doesn't care where your file was until they received (and agreed to accept it), which was on 9/12/07. So they say, they (TSC) received it on 9/12/07. Unless somebody has instructed centers to place physical files where they should have been based on the mailroom RD, it is very unlikely that they do anything but place in order they received them i.e. for your case, place your file behind those received (by TSC) on 7/11/07. It is not good, but that's what it is when they say "we process cases in order we receive them" (note that here "we" means the center, not USCIS)

It is unfortunate that it works this way, but there is no other explanation to what happens.

I am starting to see a trend in the receipt notices.

Some of the people reporting getting recepit notices this week (yesterday and today) have LUDs of 07/28/07. My thinking is that This week will see receipt notices for everyone with an LUD of 07/28/07

HOPEFULLY next week will see receipt notices for 08/05/2008. This is just my observation.

People please post your LUDs for your I-140, the service center AND how your receipt numbers start (SRC vs LIN) each time you post a receipt notice.
Can you let us know how to access LUD from USCIS after login? I think many will appreciate if you do so

I agree its tactic to scare people and attract attention. I think USCIS is far better placed today in 2009 compared to what it was in 2007. If that was not the case they would have just moved the Priority dates to Mid 2006 like they did last year. But this year they are much better prepared in their estimates. In Oct the dates might go back but it will definately not go back to Jan 2000 or U. They might take them back to mid 2004 and start slow advance from there. Next year Sep 10 bulletion hopefully they can take them to early. I am sure in Oct EB3 I will also come out of U and will be some where in early 2002 status at begining and will advance from there on.

I disagree, On IV homepage and website there are so many links of appeals. Just issing another appeal will not make a difference. I do not think a lot of us really need a greencard. A lot of my friends these days tell me not to worry about greencard after having EAD.

IV is our only hope. If you want you can contact AILA or your lawyer for help and see if they can help you. I bet a lot of us cannot even have the courage to blame our lawyers who take our money and give poor service. Just because IV core is like us and we can write anything, we feel free to blame them.

I disagree with the OP and feel that the fault is in the community. We do not really want greencards that bad.

The appeals are only for recapture of visa. They are not about USCIS's random acts and unethical practices. They are not about what USCIS has been doing for the past two months. What use is recapture if it is not issuing GC's or doing that randomly or not doing that at all . Think about it:
    1. One can have his PD current for 2 years and not get his GC. Meanwhile, he can loose his job and not get a similar one. All his steps go into drain forever.
    2. He cannot do any other thing like open up a business.
    3. He cannot get a house for the fear of being rejected.
    4. He cannot even do his present job confidently. For example, I have somebody trying to abuse my situation in my office and I cannot give him a hard reply simply because my status is hanging in there.

And yes, we do need GC's but the first step is not getting GC. The first step is to make USCIS accountable, ethical, efficient, honest and transparent.(All these things are missing in USCIS) How come a person with PD 2003 is waiting and the one with PD 2006 get his GC ? IV should raise questions on this. (Not all method involve money..I have given an example of writing letters and sending pamphlets)
    1. Is the practice of USCIS ethical ?
    2. Is it acceptable ?
    3. Would such actions if done to US citizens be acceptable ?

I think there is no action towards this at all.

This constant pestering about filling up our profiles totally pisses me off. What exactly is the idea? That a person who is not waiting for a GC can't post in these forums? What if you are not even interested in GC? Or what if you are already a US citizen? Or may be just somebody happily living in Timbuctoo, and visiting these forums just for social networking? Is this site out of bound for them?

    Give me a break guys.

It has been a real busy year with long working days and multiple complex projects that have been taking away my weekends when I first saw the news about Advocacy days planned by Immigration Voice in Washington D.C. That was definitely not another thing I had time and energy for. My first thought about the event was that I will make it if I can. As days went by I did not want to miss this event. I thought I would regret if I missed this. After a couple of years of no talks about immigration, Advocacy days provided a good opportunity to focus and advocate for issues we all have been living with for many years with many more to come. My vacation request was sent for approval to all the project managers I have been working with and got approved.
I landed in D.C saturday evening and went to the situation room on Sunday. The situation room was filled with passionate people who have made a choice to dedicate their time to advocate for issues faced by our community. All of us had a lot to accomplish over the next three days. Every one of us had anywhere between four to eight meetings with people who write laws that shape this nation and determine its future. There were a few events happening in the situation room throughout the day like registering members, giving out meeting schedules, tracking schedule changes, training members on how to handle meetings with law makers, mockup lawmaker meetings, preparing meeting materials, printing business cards, making sure everyone has necessary accommodation, making sure everyone knows where their meetings are, who their team members are etc. Towards the end of the day, former USCIS Ombudsman made a visit to the situation room and told all of us how important it is for us to take our issues to law makers and keep up with the work we have done when we go back home. Things dont happen in life if we dont try. He really felt bad for all of us who had to walk between House and Senate offices for our meetings over the next couple of days. It was around 11 PM when most of us were ready for the next day. I met my team before I left the situation room and I knew our team was high performing and would do really well. A few people stayed back to finish up and it turns out everyone who stayed back were up until 4 AM.
We had five meetings scheduled for day 1 in three different buildings on the same side of the capital building. We picked up an additional meeting over the ones we were already scheduled for since we had additional time. Everyone we met knew our issues and were very supportive. No one needed an introduction. Our team accomplished a lot on day and we felt really good. Towards the end of the day and my foot started screaming. Walking between three large buildings which serve as offices for House of Representatives and climbing steep staircases gave me one less blister compared to what I normally get after finishing a half Marathon and next day was not going to be a day of rest.
My second day turned out to be more exciting compared to the first one. I had five meetings scheduled and I was going solo for my first two lawmaker meetings. I had an opportunity to give a process overview of obtaining permanent residency (Green Card) for highly skilled legal immigrants in one office and that felt really good. After my second meeting I met my IV friends from Southern California and we all headed to our next meeting together. We went to the Rayburn cafeteria to get lunch after. Just when I thought I had luxury of having a 90 minute lunch and only two more meetings to go to for the day my foot really started screaming. The dress code on the hill did not allow me to take my shoes off and stretch my foot or wear sneakers. It felt better to sit for the next 90 minutes in the cafeteria compared to walking or standing. Our next meeting was in the Senate building which was on the other side of the Capital. Normally it would take about 10 to 15 minutes to walk to other side but it took over 40 minutes to reach the office we were supposed to get to only to find out that our meeting got rescheduled to 4:30 PM. I had a 5 PM meeting scheduled as well which did not give me enough time to stay for this meeting and head to the building I came from earlier. I split from my team and started walking towards the other side of the capitol hill for my 5 PM appointment almost an hour early because of my foot issues. I couldnt really walk for long after I left the senate building. I walked to the nearest bench in front of the capital. I didnt care about anyone watching me and just took my shoes off and sat down for the next 30 minutes before I could walk again. Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since It would not fall under same or similar category which made all of us crack up.
Our next stop was the congressional reception which gave us an opportunity to spend the evening with present and former USCIS Ombudsman, representatives from law makers offices, personnel from our lobbying group and a few prominent Immigration attorneys. Our reception was wrapped out around 8 PM and we headed to the situation room for our closing meeting. Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

We understand retrogression is due to non availability of visa but we will have some comfort factor, if we know un-used visa# that may move PD...

Anybody have any statisctics on unused visa# for last couple of years?
    Thanks in advance..

Has anyone got an idea of unused visas from EB1 and ROW EB2?

It just can't be right the EB2 movement for India and China is hardly moving since EB1 is current and EB2 ROW is current since 6-10 months.

Which category does the unused/overflow visas go?

None of the lawyers I emailed have an answer (they like this retrogression btw more $).

USCIS doesn't care if a non citizen asks a question.

My wife got her name changed on the passport last week from the DC embassy. Her original Indian passport had only her first name and her last name was blank. Her US documents (Visa, SSN, Drivers License, etc) had her name as <first_name> FNU (Family Name Unknown). For a passport name change, the Indian Embassy requires you to:
    1. Create an Affidivate in India saying that the name needs to be changed from <first_name> <blank> to <first_name> <last_name>.
    2. Publish the name change in a national newspaper.
    3. Publish the name change in a local US newspaper.

Along with the name change application, you have to submit the original affidivate, the paper clipings of the Indian newspaper and the local US newspaper.

Alternatively, if you have a marriage certificate and the marriage certificate lists your name as <first_name> <last_name> rather than <first_name> <blank> (as on your passport), you do not need the affidivate and a copy of the marriage certificate is sufficient.

The renew/change-passport-by-mail service that the indian embassy provides will take 10-12 business days (excluding Indian public holidays :) ). If you go in person to the consulate/embassy you can get your passport back within 3-5 days.

Atleast as far as I know, the DC embassy doesn't have any same-day service(don't take my word for that, I could be wrong). Good luck !

I think ur's was a simpler case than mine.

The problem with mine is that the entire name is on one single line and I would like it separated, first and last name on their respective lines. The NY consulate has refused to do so without an affidavit.

The procedures on the website also clearly say so for a name split:

CHANGE OF NAME ON AN INDIAN PASSPORT - www.indiacgny.org (http://indiacgny.org/php/showContent.php?linkid=229&partid=223&sub=sub3)

Looks like this is a battle that I will have to see through

My passport was renewed by Consulate of Chicago and the fields last name and first name were interchanged.

I used the miscellaneous service form. The reason i gave was other and also did not fill my name on the form. I took it to the consulate along with my old passport and showed them the error. They agreed to make a correction and then I filled in the name on the miscellaneous service form the the way i wanted it to look like.

They provided an endorsement on the second page of the passport and this should be good for travel and all other purposes. I did not need an affidavit as the old passport was used as the proof.

I believe you should be able to use the same.

    But, sherman has a point....
    1. Why do we put up with the inefficiencies of the American Govt?
    2. Why do we sit down and accept what is given to us instead of asking for what we want/ desire?
    3. Why do I hear - "I am not interested in protesting" or "I don't have the time" from folks that are paying a high price due to retrogression?

We are LEGAL, tax paying, resident aliens that are contributing to the economic growth and not siphoning off government funds. Don't we deserve better?

Why were there 100's of thousands of faxes sent by NumbersUSA (aka Sherman and gang) while all we could muster was a meager 20000? Where are the rest of the 1.2 million EB applicants?????

Its time we stood up and showed them our strength. We have the numbers- we just need the strenght and courage to stand up for our convictions.
