Instead of allowing US STEM graduates to get GC based on US job offer it would be beneficial to instead allow US STEM graduates to apply and get H1B without any quota. Tht way they will get into the system and don't need to go back to home country. Giving GC to STEM graduates directly is wrong by law because it bypasses labour and 140 conditions which state that a company is willing to sponser GC for a person based on current market conditions.
Its already there. 20000 for masters and phd students.
Giving GC to stem is to bypass them from EB based line, which means they won't consume numbers from 140k. Isn't this good?

As i said earlier, i relied too much on my employer as istated to him in the first place to do a change of status Visa. They didn't do it, and as i was under the impression that i didn't have to go to India to get it stamped, i didn't leave the country so far and worked all these days. The ugly thing is that even my employer didn't ask me to go to India and get my Visa stamped in India, but he did find projects for me and produced pay slips all the time so far. Now, i found out the mess i am in, that too because i was ready to apply for I-140 and I-485 together. The immigration attorney who is preparing my I-140 caught my out of status situation and all the hell broke lose. Is there a way to seek an adjustment n my status from INS based on the fact that i was eligible for Chnage of Status from L-1 to H-1 in 2005, but mistakenly, i got a H-1 that was supposed to be stamped? Would they consider any such cases? Is there any example of anybody whoever did it???
And even if i leave the country now, would i face any problem in next three years, if i attempt to come to USA on a new H1 next year, with a new Visa?
Please provide me some advice if anyone knew any situation like this before?

Even if there were some, they definitely won't be in large numbers. First of all to use a sub labor, one labor had to become available. Do you think there were so many labors floating around to grab one ? I don't think so.
How come EB3 ROW went "U" if all the backlog was due to labor subs ?
Well, There are many people still waiting for GC with original labor and not substitute labor with PD 2003 or prior to that. I'm not saying Sub Labor is the only reason, but it is one of the reason. Even though they are few...the impact is big... With 7% per country limit and visa numbers looks like would not spill over to EB3 due to demand in EB2 and other categories, even very few (say 3000 - 6000 labor sub applications) could consume a year or 2 years worth of visa numbers for this category for retro countries.... Even each family member (dependent) would consume a visa... with atleat 2 visa per applicant, 3000 - 5000 total EB3 labor sub could easily consume 2 years quote... if you count all.. then the "U" in VB might make sense... For EB3 ROW, there are lotz of people from Canada, S. Korea, Thailand, Australia, UK etc, and it went 'U' from 2003... The dates could move well for ROW... but for retrogressed country, I do not see the bright side yet.... Also the 485 PD was current for all categories almost all of 2003 & 2004 till Dec 31 2004, It retrogressed starting from Jan 2005 and later.... Also, the total 140,000 is for all EB categories. Hi,
I have applied for H1 this year and my OPT is valid for next 29 months.
I am working for A with OPT. Now when B has filed my H1B and if it gets approved in Oct 2008, will I be able to continue to work for A for some more time using my OPT status. I dont have immediate plans to work for B on H1 B and I would probably join them in May 2009, .
Will H1 B approval from a DIFFERENT company have any effect on MY OPT status. I know sometimes people get 2 H1bs from two companies.

This is very useful information. Pappu is unarguably right that it doesn't make sense to wait for a year even after paying $5K. The whole system is absurd.
I am writing mail to Ombudsman regarding delay in replying FOIA.
Guys, as IV is also putting all options and working on this, lets not loose our momentum and keep contributing towards this. Pappu's message clearly indicates that if needed, this fund will be used for this purpose specifically and also as he mentioned, we need more fund to get data earlier.

I am sorry to say this Pappu, but honestly I do feel one thing. There are some things that IV can do without spending money(which I think are not being done). For example, it can lead everybody everybody to send letters to USCIS and congressmen and the press for justice highlighting abrupt actions of USCIS. I made so many pamphlets in the thread "Lets get Organized" which can be sent alongwith to make an impact. It is not about eb2 or eb3, it is about accountability and transparency from USCIS. It does not involve any money from anybody excepting a 41 cents stamp on the letter which I think most of people should be ready to spend. However, the push from IV seems to be missing.

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item

Hi All,
I recently had my last name added on my Passport. I just submitted for updating the SSN. Couple of questions:
1. Does anybody know if I need to run the payroll and also file the taxes with new name on the SSN once it's been updated. I still need to file my 2009 taxes.
2. Do I need to inform USCIS about this or it should be OK if I just submit the new name on I-129 when I apply for renewal later this year.
3. I maintain H1B expiring Sept 2010. I might need to travel to India before expiration with the current visa. Do I need to do anything to avoid name confusion at POE?
Please share your experience. Appreciate your time.

North American naming conventions are clear, it has two essential parts, First Name and Last Name. Third part, the middle name is optional, and is also insisted upon, if you have one, to be written in full on all legal docs, such as PP, SS card etc.
Addition of something to your name probably is not adding your last name. It is rather changing your last name, legally speaking.
Therefore, this perhaps needs to be treated as a change of name, and you might need necessary legal docs to prove that, while trying to change for your taxes or other legal docs. Merely having a new passport with something added to your name, may or may not work.
